1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your use of the website, services, villa accommodations, kitesurfing activities, gemstone purchases, and excursions provided by Kite Kuveni Kalpitiya ("we," "our," or "resort").
By booking a villa, enrolling in kite lessons, acquiring a gemstone, or submitting a reservation inquiry through our website or WhatsApp concierge, you confirm that you have read, understood, and agreed to be bound by these Terms.

2. Villa Bookings & Cancellation Policy
โข Deposit Requirement: A non-refundable 30% deposit is required at the time of reservation to lock in villa dates and current seasonal rates.
โข Balance Payment: The remaining 70% balance is payable upon arrival at check-in via Credit Card, LKR Cash, or International Bank Transfer.
โข Standard Cancellation: Cancellations made 30 days or more prior to scheduled check-in will receive a deposit credit valid for 12 months. Cancellations made within 14 days of arrival forfeit the deposit.
โข Check-in / Check-out: Standard Check-in is from 2:00 PM; Check-out is by 11:00 AM. Late check-out requests are subject to availability.
โข Balance Payment: The remaining 70% balance is payable upon arrival at check-in via Credit Card, LKR Cash, or International Bank Transfer.
โข Standard Cancellation: Cancellations made 30 days or more prior to scheduled check-in will receive a deposit credit valid for 12 months. Cancellations made within 14 days of arrival forfeit the deposit.
โข Check-in / Check-out: Standard Check-in is from 2:00 PM; Check-out is by 11:00 AM. Late check-out requests are subject to availability.
3. Kitesurfing & Water Sports Safety Regulations
Kalpitiya Lagoon offers ideal wind conditions; however, kite surfing carries inherent water activity risks. Guests engaging in water sports must adhere to the following safety rules:
โข IKO Certification & Gear Rental: Independent kiters renting equipment must present an IKO Card (Level 3 or equivalent) or undergo a 15-minute competency assessment by our head instructor.
โข Safety Equipment: Impact vests and helmets are mandatory for all student kiters during lessons.
โข Weather & Safety Discretion: Instructors reserve absolute authority to alter, suspend, or cancel water sessions due to squalls, storm warnings, or unsafe wind shifts. Unused lesson hours will be credited.
โข Gear Damage Policy: Renters are responsible for negligent damage to kites or boards beyond normal wear and tear.

4. Ceylon Gemstone Acquisition & Valuation Terms
โข Authenticity Guarantee: Every natural Ceylon gemstone sold is 100% genuine and accompanied by an official laboratory certificate from the National Gem & Jewellery Authority (NGJA) of Sri Lanka or GIA.
โข Video Inspection: Buyers acquiring loose stones remotely inspect daylight videos and loupe captures via WhatsApp. Payment confirmation signifies approval of stone specifications.
โข Custom Jewelry Setting: Bespoke 18K Gold or Platinum settings require 50% deposit before goldsmith casting begins. Custom mounted jewelry cannot be returned once crafted to specific ring sizes.
โข 100% Insured Delivery: International courier dispatches (FedEx / DHL / Brink's) are fully insured against transit loss. Risk passes to buyer upon signed receipt at delivery address.

5. Tours, Safaris & Vehicle Rentals
For Wilpattu Safaris, Dolphin Watching boat trips, and airport transfers, start times are strict to match wildlife activity windows. Self-drive rental vehicles (tuk-tuks / scooters) require a valid International Driving Permit (IDP) and compliance with Sri Lankan traffic regulations.
6. Pricing, Payments & Currencies
All published prices are displayed in foreign currency estimates (USD, EUR, GBP) and calculated based on real-time exchange rates. Invoices generated in Sri Lanka are processed in LKR or USD as permitted by the Central Bank of Sri Lanka.
7. Resort Conduct & Lagoon Environmental Protection
Kalpitiya Lagoon is an ecologically sensitive marine area home to dolphins, turtles, and mangrove ecosystems. Guests must respect local wildlife, avoid littering plastic in the lagoon, and adhere to quiet hours after 10:00 PM.
8. Limitation of Liability & Force Majeure
Kite Kuveni is not liable for itinerary disruptions, flight delays, extreme weather events (monsoon squalls), or natural disasters beyond our control. We strongly recommend all guests hold comprehensive travel and medical insurance.
9. Governing Law & Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any legal disputes arising out of resort stays, water sports, or gemstone acquisitions fall under the jurisdiction of the courts of Sri Lanka.
